1. Acceptance of these Terms

These Terms of Service (“Terms”) govern your access to and use of the website fixyourcloud.com(the “Site”), operated by Fix Your Cloud LLC, a Texas limited liability company (“Fix Your Cloud,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms.

2. Permitted use

You may browse the Site, read its content, and contact us through the form or published email addresses for legitimate purposes. You agree NOT to:

  • Use the Site for any unlawful purpose or in violation of any applicable law
  • Attempt to gain unauthorized access to any part of the Site, our servers, or related infrastructure
  • Probe, scan, or test the vulnerability of any system or network connected to the Site without prior written consent
  • Interfere with or disrupt the Site, including by introducing malware, denial-of-service attempts, or excessive automated requests
  • Scrape, harvest, or extract content from the Site for commercial purposes without permission
  • Use the contact form to send spam, advertise unrelated products, or send abusive content
  • Misrepresent your identity or affiliation with any person or organization

3. Intellectual property

The Site and its content — including text, design, code, logos, product names (Fix Your Cloud, ReportIO, SpendReady), graphics, and other materials — are owned by Fix Your Cloud LLC or its licensors and are protected by United States and international intellectual property laws.

Nothing on the Site grants you a license to use any trademark, logo, or branded asset of Fix Your Cloud without our prior written consent. You may not copy, reproduce, distribute, or create derivative works from the Site's content for commercial purposes.

4. Third-party links

The Site contains links to third-party websites and services, including our product sites (getreportio.com, getspendready.com) and external vendor sites. We do not control and are not responsible for the content, privacy practices, or terms of any third-party site. Your use of those sites is at your own risk and subject to their own terms.

5. No warranties

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. To the maximum extent permitted by applicable law, Fix Your Cloud disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, and uninterrupted operation.

We do not warrant that the Site will be error-free, secure, or continuously available, or that any content on the Site is accurate, current, or complete.

6. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL FIX YOUR CLOUD LLC, ITS OWNERS, OR ITS AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION — ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, REGARDLESS OF THE LEGAL THEORY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total aggregate liability for any claim arising out of or relating to these Terms or your use of the Site is limited to one hundred U.S. dollars (USD $100).

7. Indemnification

You agree to indemnify, defend, and hold harmless Fix Your Cloud LLC and its owners, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms or your misuse of the Site.

8. Termination

We may suspend or terminate your access to the Site at any time, without notice, for any reason — including violation of these Terms. Sections 3, 5, 6, 7, 9, 10, and 11 survive termination.

9. Governing law and venue

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Site will be brought exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of those courts.

10. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top. Material changes will be highlighted on this page. Continued use of the Site after a change constitutes acceptance of the updated Terms.

11. Severability and entire agreement

If any provision of these Terms is held to be unenforceable, the remaining provisions remain in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Fix Your Cloud LLC regarding the Site, superseding any prior agreements about the same subject matter.
